The www.MerchEngines.com website is owned and operated by Fidelity Assets, LLC. The goal of the web site is to provide premium Google AdWordsTM, Yahoo! Search MarketingTM and Microsoft's MSN AdCenterTM account management services. MerchEngines (www.MerchEngines.com) is a Fidelity Assets product.

To ensure a safe environment for all users, we have established these Terms and Conditions. In this way, you will know what you can expect from us, and what we can expect from you. By accessing any areas of www.MerchEngines.com, you agree to be legally bound and to abide by the terms set forth below.

Fidelity Assets or MerchEngines has the right to revise this Terms of Service at any time without providing notice to its users. Your continued use of this Site, the Services and/or your Account shall be deemed irrevocable acceptance of those revisions. Furthermore, Fidelity Assets and MerchEngines reserve the right to change, modify, suspend or discontinue any portion of this Site or any Contest at any time. Fidelity Assets or MerchEngines may also impose limits on certain features or restrict your access to parts or the entire Site in its sole discretion and without notice or liability.

ORDERING and PRICING

The prices quoted on www.MerchEngines.com are in US Dollars.

We reserve the right to refuse to accept an order request in whole or in part. We will process your order once you have completed an order form and we have received your payment details. An e-mail confirmation of our acceptance of the order will be forwarded to you.

Pricing for our services are billed on a custom basis.

PAYMENTS

Fidelity Assets and MerchEngines.com accept Visa, MasterCard, Discover Card and American Express credit cards, via our secure online ordering system. Credit cards are charged when the order is placed and will be charged on a recurring basis until you cancel the service. The merchant name that will appear on your credit card statement will be either Fidelity Assets or MerchEngines.com.

The activation fees for new accounts with Google, Yahoo! and MSN are separate from our services fees.

You are considered an active subscriber with Fidelity Assets, LLC. as long as you have an outstanding balance with us. There will be absolutely no cancellation of your subscription until your outstanding balance is paid.

ACTIVATION OF ACCOUNT

The account becomes billable and active with Fidelity Assets and MerchEngines.com when the billing details of the client are submitted for initial processing. Upon a successful submission of valid credit card information, this is the official start of your MechEngines.com service. Your account must also be submitted to Google (and/or Yahoo! and MSN) for activation. It is the responsibility of the CLIENT to make sure that their account has been activated. Fidelity Assets can not be held responsible for the destruction, loss or ignorance of any correspondence coming from us that details the processes for activation of your advertising account and MerchEngines.com subscription. The Client will be charged automatically, regardless of the status and continuing status of their account with these companies. Fidelity Assets and MerchEngines can not be held responsible for any accounts left dormant. It is the responsibility of the client to seek help if there is a problem in activating the account.

NO REFUND POLICY

By signing up for MerchEngines.com's service, you agree to our "NO REFUND" policy. Our NO REFUND policy is as follows: There will be no refunds issued under any circumstance at any time whatsoever. Any attempted chargebacks will be denied. You become an Active Customer of ours when the billing details of the client are submitted for internal processing. Again, there are NO REFUNDS. We work hard on your behalf, so please don't ask for a refund or chargeback after we've done all of the work for you. Besides, it's just not nice to do that after all of the work we do on your behalf.

CANCELLATION OF SUBSCRIPTION

In order to cancel your MerchEngines.com subscription with us, the outlined steps must be taken. It is incumbent upon the client to seek assistance if the canceling procedure fails. Otherwise the standard rates will continue to apply and the account will remain active with MerchEngines.com and the Search Engines. There will not be a refund offered to the client us because of the failure of the client to unsubscribe and/or failure to unsubscribe without seeking assistance if any error occurs in the process. Similarly MerchEngines.com cannot be held accountable for transactions taking place with Google, Yahoo! and/or MSN because of inactivity on the part of the client in regard to unsubscribing.

PRODUCT GUARANTEE AND RETURNS

You acknowledge that we may immediately terminate your Account. Fidelity Assets or MerchEngines.com reserve the right to change the fees charged for its services and payment methods at any time. You may terminate your Account at any time; however, you will not be refunded any Service fees already paid to us upon such termination. Any refunds will be at the discretion of Fidelity Assets or MerchEngines.com.

All copyrights, trademarks and other intellectual property rights in the design, layout, wording and concepts of this web-site are reserved to Fidelity Assets, LLC and MerchEngines.com. Any copying of the design, layout, wording, concepts or other unauthorized use will infringe our rights.
